Workers' Compensation Statute of Limitations in California
When it comes to filing a workers’ compensation claim, time is not on your side. Each state enforces a strict time limit for pursuing a workers’ comp claim; this time limit is known as the Statute of Limitations.
In California, workers are required to report their injury to their employer within 30 days of their accident. After reporting your injury, you then only have 1 year to file your workers’ compensation claim, according to California Labor Code Section 5405.

How to File for Workers' Compensation
- Make sure to notify your employer of your work-related injury within 30 days
- Complete the DWC-1 form your employer gives you, or download the form online
- Give the form to your employer so they can fill out the rest (be sure to retain a copy for your records)
After filing your claim you will need to wait for your employer’s insurance company to process the claim. If the claim has not been denied or more information requested within 90 days after submitting the form, it is considered to be approved (Cal. Labor Code § 5402(b), (c) 2018).
